TERMS AND CONDITIONS OF USE

 

1. Introduction

This document sets out the terms and conditions governing the use of www.abr-ro.ro, a site administered by the Romanian Library Association (ABR). Accessing, browsing and using this site entail the complete and unconditional acceptance of the respective terms and conditions. This document regulates the users’ access, their rights and obligations, as well as the manner in which the services offered by ABR are managed.

 

2. About ABR

The Romanian Library Association, hereinafter referred to as ABR, according to the proof of name availability no. 7686/299 of 2007, issued by the Court of First Instance, Bucharest — Sector 1, is a professional and scientific organization of Romanian librarians and libraries.

ABR is an apolitical, independent, non-governmental and non-profit organization, a legal entity that is materially, structurally and functionally autonomous and operates according to the legislation in force.

ABR aims to promote and develop the library science field, to protect the professional interests of its members, to encourage scientific research in the field, as well as to strengthen the status of the librarians’ profession in the contemporary society.

 

3. Definitions

For the purpose of this document, the meanings of the following terms shall be those specified below:

Operator – the Romanian Library Association, unique registration code 10211897, with its registered address in Bucharest, Romania, 1 Boteanu street.

Site – www.abr-ro.ro website

User – any person who accesses and uses the www.abr-ro.ro site

ABR member – any natural or legal person that has registered with ABR and has paid their yearly membership fee;

Event – any activity organized by ABR that requires registration;

Account – a secured interface corresponding to a registered user;

Diploma – a digital document issued by ABR to confirm the participation at the event;

 

4. User registration and attending events

In order to register for the events organized by the association, a user account is required. The users who are already registered are not required to create a new account for each event – they can simply sign-in using their credentials and then register for the desired event.

An event can offer several participation options (packages) and the participants can choose the option which suits them best.

For example:

  • participants can opt just for the access to the event, excluding accommodation or meals, benefiting from a reduced fee;
  • other participants can also choose to pay for the accommodation, excluding meals;
  • or can opt for a full package, including accommodation and meals. 

The user account allows members to:

  • pay the participation fee for various events;
  • choose and pay for the optional services available for each event (e.g.: breakfast, lunch, dinner, accommodation);
  • access their previous orders and registrations. 

The registering users can opt to pay the yearly ABR membership fee amounting to 60 lei and 4 lei for the registration fee. For this fee, the users benefit from:

  • access to supplementary information which is not available to the general public;
  • discounted participation fees for various events organized by the association;
  • access to a dedicated interface, intended only for the members, available after signing-in;

After signing-in, the members can:

  • pay the ABR membership fee;
  • pay the participation fees for various events;
  • buy books (this feature is still under development);
  • view and download the participation diplomas corresponding to each event;
  • access a continuous professional development online platform, which will allow them to further study and research their professional field.

There are – or may be – users which are not registered ABR members. Although they can browse the site, they shall not be able to access some information and certain sections.

The restricted content shall be marked by a lock icon placed next to the respective menu. When accessing these sections, the users shall be notified they need to be registered in order to view the full content.

 

5. ABR membership

Any natural or legal person interested in the library science field is eligible to become a member of the Romanian Library Association, after agreeing to the association’s statute and objectives.

The members have the following rights:

  • to participate at the activities organized by ABR;
  • to benefit from various facilities, discounts or preferential access to certain services and events;
  • to receive participation diplomas and other materials meant for the members;
  • to access the continuous professional development online platform.

The members also have the obligation to observe and comply with the ABR statute and to pay the yearly fee (the membership fee), according to the association’ internal regulation.

 

6. Payments and provided services

All payments made through this site are intended for participation at events and for events-related services. The association reserves the right to amend the list of available services or the fees, after the prior notification of the users.

 

7. Payment refunds. Waiver of services. The right of withdrawal.

The membership may be terminated, in accordance with the provisions of art. 17 of the Association’s STATUTE. If the membership is terminated after the payment of the membership fee for the respective year, the fee shall not be refunded.

The participation fees for the events may be refunded only in exceptional circumstances, upon a written explanatory request, subject to ABR management’s approval. The request must be addressed to the ABR management and sent at least 2 (two) weeks ahead of the event. The refund shall be made to the account from which the fee has been paid or to another account, as specified by the applicant.

The refund fees (the bank charges) shall be borne by the applicant.

 

8. Copyright and use of content

The content of this site (texts, images, graphics, logos etc.) is protected by copyright laws and belongs to the Romanian Library Association or its collaborators.

It is prohibited to copy, distribute, modify or reuse the content of the website for any purpose without the prior written consent of the Association.

The entire website is protected by Law no. 8/1996 on copyright and related rights, and for any infringement of intellectual property, we reserve the right to refer to the competent courts for the full recovery of the loss or damage, as well as to file a criminal complaint with the judicial authorities, to hold the offender criminally responsible.

 

9. Personal data protection (GDPR). Confidentiality

According to the requirements of law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, amended and supplemented, and of law no. 506/2004 on the processing of personal data and the protection of private life in the electronic communications sector, the site managed by ABR has the obligation to administer safely and only for the specified purposes the personal data provided by the users.

By creating an account and using our site, you agree that the Romanian Library Association can collect and process your personal data for the purposes below:

  • administering the user account;
  • managing the participation at events;
  • providing relevant information regarding the Association’s activity.

Your data shall not be disclosed to third parties without your prior consent, save as provided by the law.

abr-ro.ro uses Google Analytics to analyze the way the users make use of the site. Google Analytics uses cookies to collect standard registration information and information regarding users’ activity. The information collected is totally anonymous.

Cookie-generated information on the manner the users the site (including the IP addresses) is transmitted to Google. This information is then used to evaluate how users use the site and to generate statistical reports on the activity of the site. ABR shall not use this statistical data to associate the identity of a user with an IP address.

We may collect information through other cookies or other similar technologies (such as the IP address), and to collect details regarding the browser or the device you use. For more information, please see our Cookies Policy.

ABR reserves the right to send newsletters to the registered users or to those who have ordered various services, promotional materials etc from www.abr-ro.ro. Registered users may unsubscribe from the list at any given time, by using the link [unsubscribe] at the end of the e-mail.

Right to erasure the processed data:

You have the right to request the erasure of personal data we have collected and processed on the site by e-mailing us the following form at contactabr-ro.ro or by post to the address of the Operator.

 

10. How we use cookies

The cookies themselves do not require any personal information in order to be used and do not, in most cases, identify the internet users.

The site uses its own cookies as well as third-party cookies in order to improve user experience, provide essential functionalities and analyze site traffic. By using our site, you agree to their use, according to the policy detailed in the “Cookies Policy”.

11. Limitation of liability

The Association shall use its best endeavors to ensure the accuracy of the information published on the site, but shall not be held liable for any errors or interruptions to the operation of the site.

 

12. Force majeure

ABR shall not be held liable for non-performance of contractual obligations or of the obligations under this document, if they have been caused by force majeure, as defined by the legislation in force.

 

13. Modification of Terms

The association reserves the right to modify these Terms and Conditions of Use at any time, without a prior individual notification. The updated version of this document shall always be published on this web site.

Your continued use of the site, following the modification of the Terms and Conditions, constitutes your tacit agreement to the new provisions.

This document shall be supplemented with the provisions of ABR’s Statute and those of the internal regulations adopted by the Association, as appropriate.

 

14. Final clauses

If any provision herein is found void or unenforceable, it shall not affect the validity of the other clauses. The applicable law is the law of Romania, a court of competent jurisdiction.
